Why Study Enforcement of the Code of Ethics?
REALTORS® should study the Code of Ethics to understand the enforcement process so that they can be prepared if they are accused of unethical conduct, if they believe another REALTOR® has behaved unethically, and they wish to file an ethics complaint, if another REALTOR® requests arbitration against them for a disputed commission, or if they wish to request arbitration against another REALTOR® for a disputed commission.
When a licensee chooses to become a REALTOR®, they agree to abide by the Code of Ethics and cooperate with code enforcement. Code enforcement typically addresses two primary issues. An arbitration request, which concerns money, typically a disputed commission. The REALTORS®' agreement to arbitrate monetary disputes, not litigate them, is one of the most distinct parts of the Code of Ethics. An ethics complaint, which concerns behavior. An ethics complaint can result in severe penalties for a REALTOR® depending upon the seriousness of the violation.
All complaints go to the Grievance Committee at the local level. The makeup of that committee changes annually when the committees are reset at the local board level. Because each board has its own committees, there is local autonomy. Depending on how well versed the committee members are in the Code of Ethics, they may either send a complaint forward or dismiss it.
If the complaint is moved forward from the Grievance Committee to the Professional Standards Resources, a hearing is held by the Professional Standards Hearing Panel; a subset of the Professional Standards Committee.
Upon course completion, not only will the real estate professional have a better understanding of The Code of Ethics but they will also understand the enforcement process of The Code of Ethics is enforced at the local level by the local associations.
