An FTC survey showed that 71% of the buyers surveyed and 82% of the sellers responding thought the agents that were working with the buyers represented the buyers and their best interest, when in fact, those agents represented the sellers by virtue of their sub-agency relationship established through multiple listing. Furthermore, 73% of the buyers surveyed responded that they had told the licensee with whom they were working the highest price that they would pay for a property and 83% thought that such information would be held confidential.
Real estate professionals have become increasingly concerned about the potential legal consequences for practicing in a manner that led to such a huge misunderstanding for all involved, including the brokers and salespersons. It was clear that an effort had to be made to ensure that real estate professionals knew whom they were supposed to represent in a transaction and to ensure that the public was made aware of who did or did not represent them in a transaction. As a result, regulators and real estate trade associations became very aggressive in confronting the situation.
